I'd not hesitate in making them totally responsible for any costs incurred due to their ignoring the law. Sadly, I doubt any government has the testicles to do it.
I once knocked over a teenager playing chicken in the road. I was left to face the repercussions. The police told me that pursuing a claim against the miscreant was a waste of time and money as the courts would deem that they had already suffered enough.
